This privacy policy (“Policy”) sets out how Ypsomed AG, Brunnmattstrasse 6, 3401 Burgdorf, Switzerland (“Ypsomed”, also referred to as “we”, “us” and similar terms throughout this Policy), its affiliates and service providers process personal information of users of the YpsoPump Explorer app (the “App”).

When you use the App and consent to the use of data analytics on the App, you consent to the collection, use and disclosure of your personal information by Ypsomed, its affiliates and service providers in accordance with the terms and conditions of this Policy.

This Policy gives an overview of which personal information we process and how we use that personal information, as well as your rights according to applicable privacy and data protection laws.

2 Personal Information Collected

Some personal information of App users may be collected automatically, while other personal information may be provided to us directly by App users.

We may collect personal information that can help us improve our App and services, such as your IP address, device identifier and activities within the App, as described further below under the heading “Unity Analytics”. We only collect this information if you consent to the use of data analytics on the App.

If you consent to the use of data analytics on the App, we may also collect personal information, such as your country of residence, preferred language, age range, and how you learned about our App. We only collect this information if you provide it to us within the App.

3 Purposes

We will only process your personal information for the purposes and reasons specified in this Policy or during the collection process, or as otherwise permitted or required by law, including for the following purposes:

  • To compile and analyze statistics to improve our App and products;
  • To improve user experience;
  • To maintain and improve the App’s performance; and
  • To identify and correct any errors or technical difficulties.

We will not sell or otherwise transfer the personal information you provide to us to any third parties for direct marketing use.

4 Unity Analytics

If you consent to the use of data analytics on the App, your IP address, device identifier and activities within the App will be disclosed to Unity Technologies Finland OY (“Unity”), located in Helsinki, Finland.  This information will be used by Unity to generate aggregate, anonymous reports for Ypsomed, which assist us in maintaining and improving App users’ experience with the App and Ypsomed’s products and services.  For example, Ypsomed may receive reports about the types of devices running the App to determine how to support updates on an ongoing basis.

Unity may also use your IP address, device identifier and activities within the App for its own purposes, including to inform its design of other products and services, to make decisions about whether to support certain device models in the future, and to analyse crash reports and improve its products accordingly.  Unity Analytics’ processing of personal information is governed by its own Privacy Policy, which we encourage you to review prior to consenting to the use of data analytics on the App.

If you do not consent to the use of data analytics on the App, this will not affect your use of the App.

Likewise, you may opt-out of Unity’s data analytics at any time and this will not affect your use of the App.  Please note, however, that any opt-out will not have retroactive effect.  To opt out of the use of data analytics on the App:

  • Open the App;
  • Open the main menu;
  • Select “Language & Privacy Settings”;
  • Scroll down and click on “To opt out of Analytics click here”; and
  • Read and follow the instructions displayed.

5 Data Security

We implement appropriate technical, physical, administrative and organizational security measures to protect your personal information against loss, theft or unauthorized access, retrieval, disclosure, use or modification.

Although we take steps to safeguard the personal information under our control, "perfect security" does not exist online. In particular, we cannot guarantee the security of information transmitted using the App. It is possible that third parties may unlawfully intercept or access such information.

Your personal information may be kept in electronic or paper format in Quebec, Canada, as well as in Switzerland and Finland.

6 Disclosure of Personal Information

We may share your personal information with Ypsomed’s affiliates, including Ypsomed AG (located in Switzerland) and Ypsomed Canada Inc. (located in Quebec, Canada). Our affiliates will only use your personal information as described in this Privacy Policy. Your personal information will be accessible to employees of Ypsomed AG and Ypsomed Canada Inc. who have a need to know such information, including our Product Management and Development teams.

We only share your personal information with third parties if you consent to data analytics. In this case, your personal information will be shared with Unity, as described further above under the heading “Unity Analytics”.  Please note that we may change or add third party service providers at any time, in our sole discretion, either in Canada or elsewhere. We encourage you to review our Policy from time-to-time to obtain updated information about our service providers.

There are certain circumstances where Ypsomed may collect, use or disclose your personal information without notice or consent when permitted or required by law or lawful authority.  For example, from time to time, we may be compelled by legal action to disclose personal information, including, for example, when responding to a subpoena, or in the case of a search warrant, court order or other legally binding request.

7 International Transfer of Personal Information

The global nature of our business sometimes requires us to disclose personal information to our service providers and/or to our affiliates who may be located in Switzerland, Finland, the European Union or elsewhere outside of Canada.  Accordingly, your personal information may be transferred outside of Canada to a country that does not have the same data protection laws as Canada.  Such personal information will be subject to the legal requirements of the applicable foreign jurisdiction(s) and may be accessible to courts, law enforcement and national security authorities in each jurisdiction where it is accessed or stored.  To obtain written information about our policies and practices relating to our service providers outside of Canada, please contact our Data Protection Officer at the contact information under the ‘Contact’ heading above.

8 Retention of Personal Information

When your personal information is no longer needed by Ypsomed for the purposes described in this Policy, or for other legally permissible reasons, we will securely delete or anonymize your personal information.

9 Your rights

Please contact our Data Protection Officer at the below coordinates if you would like to:

  • Ask any questions or express any concerns about this Policy or any other matter related to our collection, use, protection, retention or disclosure of your personal information;
  • Access, correct or update your personal information, or request an accommodation in connection with exercising such rights;
  • Withdraw your consent to our continued use or disclosure of your personal information, subject to reasonable notice and legal restrictions;
  • Obtain written information about our policies and practices with respect to service providers (including affiliates) outside Canada, or ask questions about the collection, use or storage of personal information by our service outside Canada for or on our behalf; or
  • Request a copy of this Policy in another format.

You may ask for access to the personal information that we hold about you, as well as for information about our handling of your personal information.  Access will generally be provided free of charge.  In certain circumstances, we may decline or be unable to provide access to some or all of the personal information that we hold about you, where permitted or required by applicable law.  If we do not provide you with access, we will generally provide you with an explanation.

Our App may contain links to Ypsomed’s Canadian website, to App stores and/or to social media platforms.

Ypsomed describes the privacy practices of its Canadian website in its Privacy Policy, as may be amended from time to time. We recommend that you carefully review and consider the Privacy Policy on our website periodically to understand how we process the personal information of our website visitors and to apprise yourself of any updates or changes in this respect.

The App may contain a link that allows you to rate the App in the app store from which it was downloaded.  The app store may collect your personal information in connection with such rating, in accordance with the app store’s own personal information handling processes. Ypsomed does not receive or process any personal information from such ratings in the app stores.

The App may also contain links to Ypsomed’s pages or profiles on various social media platforms. Each social media platform may collect your personal information in connection with your visit to Ypsomed’s page or profile, in accordance with the platform’s own personal information handling processes.  Ypsomed does not receive or process any personal information from or about App users who visit our social media pages or profiles.

The collection, use, disclosure, access to, retention and handling of personal information on or by an app store or social media platform is governed by the store or platform’s own privacy practices, including their privacy policies, as may be amended from time to time.  Ypsomed has no liability or responsibility for such stores’ or platforms’ handling of personal information.  We recommend that you carefully review and consider the privacy policies and practices of an app store or social media platform before sharing any personal information with or on the platform and review that store or platform’s policies and practices periodically to understand any updates or changes.

11 Changes to the Privacy Policy

The contents of this Privacy Policy may be amended from time to time in order to comply with legal requirements, to implement changes or updates to our App, to reflect any changes in the way we handle the personal information of App users, or for another purpose. We reserve the right to change this Policy at any time.
